This privacy policy dictates the manner in which Pacific Well-Being may collect, use, maintain, and/or disclose information collected from each pacificwellbeing.ca website (“Site”) user (“User(s)”). This privacy policy applies to the Site and all products and services offered by Pacific Well-Being. Pacific Well-Being, We, Us, the Owner, Our, My, I, and Jennifer all refer to Pacific Well-Being. You, Your, Client, Customer, and similar terms refer to you, the User.
Your acceptance of these terms
By using this Site, you indicate your acceptance of this policy. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed to be your acceptance of those changes. By using this Site, You acknowledge and accept that you have read, understood, and agree to these terms and conditions and privacy policy terms.
Personal identification information
We may collect personal identification information from Users in a number of ways, including, but not limited to, Users visiting our Site, booking a service, subscribing to our newsletter, responding to a survey, filling out a form, and/or in connection with any other activities, services, features, or resources we make available on our Site. Users may be asked for their name, email address, mailing address, phone number, or social media user name. Users may also choose to browse our Site anonymously. We only collect personal information when Users directly voluntarily submit said information to us. Users can always refuse to supply personally-identifying information with the knowledge that doing so may preclude them from certain benefits and engagement with our Site, such as booking an appointment.
Booking an Appointment: You agree to provide your name, email, and phone number so that Pacific Well-Being can contact you to confirm your appointment. This information is confidentially collected and stored.
New Client Intake Form: Upon booking an appointment, you will be asked to complete the New Client Intake Form, which collects further detailed information on your physical and mental health status. This information is confidentially collected and stored.
Non-personally-identifying information
We may collect non-personally-identifying information about every User’s interaction with our Site, include the browser name, the type of computer and operating system used, the physical location from which they browsed, and other technical information about Users’ means of connecting to our Site.
Web browser cookies
Our Site may use “cookies” to enhance the User experience. A User’s web browser places cookies on their hard drive to keep records for page refreshing and sometimes to track information about usage. A User can choose to set their web browser to refuse cookies or to alert them when cookies are being sent. If they do so, please note that some parts of the Site may not function as intended.
How we use collected information
Pacific Well-Being may collect and use Users’ personally-identifying information for the following purposes:
To improve customer service via supporting User needs more efficiently and effectively
To personalize the User experience, to analyze how aggregate Users use the services and resources provided on our Site
To improve our Site given the feedback you provide
To run promotions, surveys, or other Site features
To send via email information Users have agreed to receive, about topics that we think will be of interest to them
We may use email addresses to send Users information and updates pertaining to their interests and our services, and to respond to their inquiries, questions, and/or other requests. If the User decides to opt-in to our mailing list, they will receive emails that may include company news, updates, related service information, etc. If at any time the User would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.

Payment for Services
You acknowledge that your payment for services on the Site relies on a third-party payment service (Stripe.com, owned by Stripe, Inc.) and that Pacific Well-Being has no control over nor is responsible for any actions taken by such third parties or for the continued provision of services by those third parties. Stripe.com is in no way affiliated with Pacific Well-Being. You also acknowledge that all charges and fees incurred in connection with Your use of the Site, included using the payment site, are your responsibility.
Use of the Site
You agree to use this Site only for its intended purpose. Any misuse of the Site by You will entitle Us to terminate your bookings, remove comments, or block You from the Site. Prohibited uses of the Site include but are not limited to spam, the use of bots or other malware, libellous or malicious postings, or any material posted that is deemed inappropriate by the Owner.
Disclaimer of Warranty and Disclaimer of Liability
NOTWITHSTANDING ANY OTHER TERM OF THIS AGREEMENT OR ANY STATEMENT, UNDERSTANDING, OR REPRESENTATION MADE BY THE OWNER OF ANY CONTENT ON THE SITE, PACIFIC WELL-BEING WILL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO YOU FOR ANY OF THE FOLLOWING:
Duty to Report: While taking utmost care to respect and maintain your confidentiality, Pacific Well-Being may be required by law or by a court to disclose information You have provided through the Site and to which We have access. We have a Duty to Report to any legal authorities or at-risk third-parties any threats of self-harm or harm-to-others.
No Diagnosis or Prescription: Pacific Well-Being offers counselling and information of a general nature. None of the information on the Site can or should be used for the purposes of diagnosis or treatment and no such information should be considered medical opinion, diagnosis or prognosis, or any opinion concerning the appropriate treatment of any medical, psychological, psychiatric, naturopathic, or other condition.
Indemnity: You agree to indemnify and save harmless Pacific Well-Being and its officers, directors, employees, and representatives from any loss, damages, liability, cost, and expenses (including without limitation any fine, levy, or other charge imposed by any government or governmental agency and all legal costs and expenses on a solicitor and own client basis) suffered by Pacific Well-Being directly or indirectly as a result of or arising out of any breach of this agreement including, without limitation, resulting from a claim or threatened or pending claim by any person that the use of Our services causes loss or damage to any person or that any material You have provided infringes, breaches, or otherwise misuses the intellectual rights of any person.
Disputes: All disputes arising out of this Agreement or relating to any relationship arising out of this Agreement, or Your use of the Site or any Services will be referred to and finally determined by arbitration before a single arbitrator appointed and acting in accordance with the Domestic Commercial Arbitration Shorter Rules of Procedure in force at the particular time of the British Columbia International Commercial Arbitration Centre. If the parties are unable to agree on an arbitrator, an arbitrator will be appointed by the British Columbia International Commercial Arbitration Centre. The arbitrator may, both during and at the conclusion of the arbitration, make orders as to costs of both the arbitration and the legal and other costs of the parties. Any party may apply to a court of competent jurisdiction for such interim relief as the court considers appropriate pending the determination of the arbitrator. The place of arbitration shall be Vancouver, British Columbia. This Agreement will be governed by and interpreted in accordance with the law of British Columbia.
Changes to this privacy policy
Pacific Well-Being is at the discretion to update this privacy policy at any time. When we do so, we will revise the date at the bottom of this page. We encourage Users to frequently check this page for any changes to stay informed about how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of its modifications.
